Your purchase and use of this Hotelgiftcard (“Card”) and Hotelgiftcard.com constitutes acceptance of these Hotelgiftcard Terms and Conditions (“Terms”), the Hotelgiftcard.com Terms of Service, and our Privacy Policy. Please read the full Terms carefully prior to making your purchase. Key terms and conditions applicable to this Card are as follows:

A Hotelgiftcard has been issued by Giftcards Group B.V. It may only be purchased at hotelgiftcard.com and can only be redeemed for booking accommodations through hotelgiftcard.com by entering the code shown on the Card when prompted during the booking process. It is not reloadable, refundable, or redeemable for cash, except where required by law. LOST, STOLEN, OR MISUSED CARDS WILL NOT BE REPLACED. Card is void if copied, altered, transferred, purchased, or sold. Treat Hotelgiftcards like cash. The available balance on Hotelgiftcards does not expire and there are no inactivity or service fees associated with use of the Card. The balance remains valid until fully used. Use of a Hotelgiftcard constitutes acceptance of the Terms and Conditions available at www.hotelgiftcard.com. All sales of Cards are final and cannot be refunded. Issued by Hotelgiftcard.com B.V., a company organized under the laws of the Netherlands. These Terms and Conditions (also referred to as “Terms of Service”) form a contract between you and Hotelgiftcard.com B.V. which governs the purchase, use, and redemption of Cards and related services available on this website. For balance inquiries, questions, or customer support, please visit hotelgiftcard.com or call +1-888-360-0817. Applicable terms and conditions are subject to change without notice. If the laws pertaining to this Card require additional or different terms or conditions, then such terms and conditions shall apply. Void where prohibited.

THESE TERMS OF SERVICE CONTAIN AN ARBITRATION PROVISION THAT WAIVES YOUR RIGHT TO A COURT HEARING AND/OR A JURY TRIAL AND A CLASS ACTION WAIVER THAT WAIVES YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION LAWSUIT TO ENFORCE THIS CONTRACT.

Use of Hotelgiftcard
Your purchase and use of Hotelgiftcard is governed by these General Terms and Conditions of Hotelgiftcard.com, which outline how the Card works, its validity, and your rights as a User.

Bookings through our website
If you use Hotelgiftcard to make a booking, this is processed via the Expedia Partner Network. The following additional terms will apply:

The Booking Terms and Conditions of Expedia Inc. / Travelscape LLC, which must be accepted during the booking process.
The terms of the chosen accommodation provider, including cancellation policy, house rules, and any additional charges, which are clearly shown during booking.

The role of Hotelgiftcard.com
We provide the platform and the Gift Card product, but we are not a party to the final contract between you and the accommodation provider.
Hotelgiftcard.com (HGC) acts solely as an intermediary and does not issue invoices for accommodation bookings.

In these Terms and Conditions, the following definitions apply:

1. Hotelgiftcard.com (HGC): The company operating the Hotelgiftcard platform.

2. User: Any individual who purchases or redeems a Hotelgiftcard.

3. Agreement: The contractual relationship between the User and HGC.

4. Gift Card: Hotelgiftcard issued by HGC or its authorized Resellers, loaded with a prepaid value.

5. Balance: The prepaid monetary value on Hotelgiftcard, up to a maximum of USD 1,200, available for bookings.

6. Remaining Balance: Any unused portion of the Balance following partial redemption.

7. Partner Properties: Accommodation providers accessible via the Expedia Partner Network, bookable using Hotelgiftcard. HGC has no direct contractual relationship with these providers and acts only as an intermediary.

8. Expedia Partner Network: The booking platform integrated with HGC for accommodation listings and reservations, operated by Expedia Inc. / Travelscape LLC.

9. Resellers: Businesses authorized to sell Hotelgiftcard on behalf of HGC.

3.1 Multiple relationships
Use of Hotelgiftcard and booking of accommodation via the HGC website involves separate legal relationships:

Between the User and HGC (covered by these Terms),
Between the User and Expedia Inc. / Travelscape LLC,
Between the User and the selected accommodation provider.

3.2 Acceptance of Terms
By purchasing or using Hotelgiftcard, the User accepts these Terms in full.

3.3 Acceptance of third-party terms
By completing a booking, the User acknowledges and accepts the Booking Terms and Conditions of Expedia Inc. / Travelscape LLC, and the terms of the selected accommodation provider.

3.4 Changes to Terms
HGC may update these Terms at any time by posting an updated version of the Terms to this location, or by providing such notice of said update as expressly permitted and/or required by applicable law. Accordingly, please review these Terms periodically to confirm compliance with any updates. Continued use of our services constitutes acceptance of the updated Terms.

3.5 Deviations
Any deviation requires written confirmation by HGC.

3.6 Transfer of rights
HGC may transfer its rights and obligations under these Terms to affiliates or third parties, provided this does not materially disadvantage the User.

4.1 Purchase
Hotelgiftcard may only be purchased via HGC or through authorized Resellers.

4.2 Responsibility
The User is responsible for safe handling of Hotelgiftcard and its codes.

4.3 Redemption
The Balance may only be redeemed through hotelgiftcard.com for accommodation booked with Partner Properties. We reserve the right to correct the balance of a Hotelgiftcard if we believe that a billing error has occurred, and we disclaim all liability for any such billing errors.

4.4 Transactions
Payments made using Hotelgiftcard are final once confirmed via the HGC platform.

4.5 Validity and expiry
- Hotelgiftcard does not expire and is not subject to inactivity fees.
- Where required by state law, small remaining balances may be redeemed in cash upon request (e.g. under $5 in California and other states).
- If mandatory consumer protection laws in the User’s state differ, those laws will prevail.

4.6 Transferability
Hotelgiftcard may be gifted or transferred to another person without charge. Unauthorized resale or commercial distribution is prohibited.

4.7 Service fees
HGC may charge service fees for bookings made via the Expedia Partner Network. Any fees will be displayed during checkout.

5.1 Loss or theft
HGC is not liable for lost or stolen Hotelgiftcards, except where required by law. Risk of loss and title for Hotelgiftcards pass to the purchaser upon transfer or electronic transmission to the recipient; for the avoidance of doubt, such recipient may not always be you. Hotelgiftcards cards are void if copied, altered, or subsequently transferred, purchased, bartered or sold in violation of these Terms and/or applicable federal, state, or local laws. HGC WILL NOT REPLACE LOST, STOLEN, OR MISUSED CARDS, EXCEPT AT ITS SOLE AND ABSOLUTE DISCRETION AND WITH PROOF OF THE LAST BALANCE OF THE HOTELGIFTCARD, FROM ITS OWN RECORDS OR FROM YOUR RECORDS.

5.2 Fraud or misuse
In cases of misuse or suspected fraud, a Hotelgiftcard may be blocked suspended, canceled, delayed, or deactivated. HGC reserves the right to take legal action and/or such other action as it deems appropriate, and/or to report you to the appropriate law enforcement authorities.

5.3 Damaged cards
If a Hotelgiftcard is damaged, the balance may be transferred to a replacement card, subject to fees.

6.1 Intermediary role
HGC acts solely as intermediary for accommodation bookings via the Expedia Partner Network. The contract for accommodation is between the User, Expedia, and/or the Partner Property.

6.2 No responsibility for third-party services
HGC assumes no responsibility for the performance of services by Expedia or Partner Properties, and is not responsible for the content or practices of third-party sites linked from our platform. Certain services, features, or components of our website may be delivered by third-party providers. By using any such third-party feature, service, or functionality, you acknowledge and consent that we may share information and data with the applicable third-party provider as may be required to enable and facilitate the requested feature, service, or functionality. We expressly disclaim all responsibility and liability for any third-party materials, programs, applications, tools, products, and services made available or accessible on our website, and you agree that we will not be responsible for any loss or damage incurred as a result of your use of, or access to any such materials, or from your communications or transactions with any third party.

Additional notices, terms, and conditions may apply to services, receipt of (or access to) certain materials, participation in a particular program, and/or to specific portions or features of the website delivered by third parties, including without limitation the terms of third-party tools, applications, and APIs. Your use of any such third-party feature, tool, application, or API is conditioned on your acceptance of all third-party terms applicable thereto, and you agree to abide by all such terms. You further agree that (a) these Terms of Service operate in addition to any terms of use imposed or required by any such third-party provider; and (b) these Terms of Service supplement and do not alter or amend any such third-party terms of use.

6.3 Limitation of liability
To the maximum extent permitted by law, HGC’s liability to you in any claim, suit, or other proceeding brought in connection with the subject matter of these Terms of Service is limited to:

the amount paid by the User for the specific product or service giving rise to the claim, or
at HGC’s discretion, an amount not exceeding three (3) times the value of the purchased Hotelgiftcard.

To the extent permitted by applicable law, you agree to release, indemnify, defend, and hold harmless HGC and its subsidiaries, affiliates, suppliers, distributors, and advertising agencies, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of receipt or use or misuse of any Hotelgiftcard, including any related travel.

Regardless of the form of claim or action (whether in contract, negligence, statutory liability, or otherwise), we are not liable for any loss or inaccuracy of data, loss or interruption of use, or cost of procuring substitute technology, goods, or services, any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or revenue, even if we have been advised of the possibility of such damages.

6.4 Disclaimer of warranties
Hotelgiftcard and the HGC platform are provided “as is” and “as available,” without warranties of any kind, express or implied. To the maximum extent permitted by law, HGC disclaims all representations and warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Use of our website and services is entirely at your own risk.

Certain jurisdictions and laws may not permit some or all of the disclaimers of liability set forth in this Article. in the event that such a jurisdiction or law applies to the subject matter of these Terms of Service, the foregoing disclaimers will apply to the maximum extent permitted under applicable law.

6.5 Exclusions
HGC is not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, travel opportunities, or revenue, even if advised of the possibility of such damages.

6.6 Force majeure
HGC shall not be liable hereunder for any delays or failures caused by events beyond its reasonable control (e.g. strikes, outages, government actions, disasters, public health emergencies, or failures of telecommunications networks).

6.7 Downtime
Temporary unavailability of hotelgiftcard.com or the booking system does not entitle the User to compensation.

10.1 Governing law
These Terms are governed by the laws of the State of New York, excluding conflict of laws.

10.2 Mandatory laws
Where U.S. state consumer laws provide mandatory rights (e.g. expiry rules, cash redemption), those provisions prevail.

10.3 Binding arbitration
If applicable under U.S. law, you and Hotelgiftcard.com B.V. agree to resolve any dispute, claim, or controversy through individual binding arbitration, and not in court.

Before initiating arbitration, both parties agree to make a good-faith effort to resolve the dispute informally by notifying the other party in writing and allowing 60 days to reach a resolution. Notices should be sent to [email protected].

If no resolution is reached after this 60-day period, either party may initiate binding arbitration.

Arbitration shall be conducted in accordance with the Consumer Arbitration Rules of the American Arbitration Association (AAA), and held in the Netherlands or remotely, unless both parties mutually agree to a different neutral forum.

This agreement to arbitrate and waive class actions is enforceable to the fullest extent permitted under applicable U.S. federal and state law, regardless of the customer’s state of residence.

To the extent any claim is not subject to arbitration, both you and Hotelgiftcard.com B.V. waive the right to a jury trial.

10.4 Class action waiver
YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, PRIVATE ATTORNEY GENERAL ACTION, OR ANY CONSOLIDATION WITH OTHER ARBITRATIONS TO THE FULLEST EXTENT PERMITTED BY LAW.

10.5 Good-faith negotiation
Before arbitration, both parties agree to attempt good-faith resolution within 60 days of written notice.

10.6 Forum
Unless otherwise agreed, arbitration shall be conducted in the Netherlands or remotely. However, if mandatory U.S. law requires arbitration to be held in the United States for consumer protection purposes, arbitration will instead be conducted in the State of New York, or remotely, in accordance with the rules of the American Arbitration Association (AAA).

10.7 Severability
If any provision of these Terms is found unlawful or unenforceable pursuant to operation of applicable law, said provision shall be removed herefrom or reformed to the minimum extent required to give effect to such law, and the remaining provisions shall remain valid and in full force and effect to the maximum extent permitted under applicable law. Our failure to insist on strict performance of any of these Terms of Service will not operate as a waiver of any subsequent default or failure of performance. No waiver by us of any right under these Terms of Service will be deemed to be either a waiver of any other right or provision or a waiver of that same right or provision at any other time. These Terms shall be interpreted to give maximum effect to the parties’ intent permitted under applicable law.

10.8 Entire Agreement and Relationship of the Parties
These Terms are the complete agreement between you and Hotelgiftcard.com B.V. and supersede all prior agreements and understandings pertaining to its subject matter (whether written or oral). The relationship established under these Terms of Service is that of independent contractors, and nothing herein shall be construed as creating any joint venture, partnership, employment, or agency relationship.

11.1 All content, designs, text, images, graphics, logos, icons, and software on this website are the property of Hotelgiftcard.com B.V. or its licensors, and are protected by intellectual property laws.

11.2 You may not copy, reproduce, modify, distribute, display, perform, or otherwise use any content from our website without our prior written consent.

11.3 The names, logos, trade dress, and trademarks of Hotelgiftcard.com B.V. may not be used for promotional or commercial purposes without prior written approval.

11.4 Third-party trademarks remain the property of their respective owners. Use of any third-party brand names, trademarks, or logos on this site is solely for the purpose of identifying the associated gift cards and does not imply any affiliation with or endorsement by the respective brand owners.

11.5 “Feedback” means any feedback, recommendations, enhancement requests, suggestions, testimonials, endorsements, or ideas for improvement communicated by you to us regarding our website, products, and/or services. From time to time, you may voluntarily provide Feedback to us, whether or not in response to specific requests or solicitation. In such event, you grant to us a perpetual, irrevocable, fully transferable, freely sublicensable, royalty-free, worldwide license to make, have made, use, import, offer for sale, sell, reproduce, distribute, modify, adapt, prepare derivative works of, display, perform, and otherwise exploit such Feedback for any purpose in our discretion without restriction. The foregoing license to Feedback shall survive the termination or expiration of these Terms of Service for any reason.

12.1 We reserve the right to view, monitor, and record your activity on our website and related services, platforms, and applications without any prior notice to or permission from you. Our provision of our website and services is subject to existing laws and legal process, and nothing contained herein shall restrict or reduce our ability to comply with governmental, court, and law enforcement requests or requirements involving your use of the same, or information that we receive or collect with respect to such use.

12.2 We reserve the right, in our sole discretion, to terminate or suspend your access to any site, service, feature, platform, or application that we provide, without notice to you, for any purpose in our discretion, including without limitation if we reasonably determine or suspect that you are in violation of these Terms of Service or any applicable law, and/or that your continued use thereof would cause harm to any person or entity.

SCAM ALERT: Gift cards are for gifts — NOT payments.

Never purchase gift cards for the purpose of transferring money or paying another person.

No legitimate government agency, law enforcement, utility, tech support, business, employer, or romantic interest will EVER ask you to pay with gift cards. Gift cards cannot be used to pay debts, taxes, fines, fees, bail, or “emergencies.”

Be suspicious of anyone who contacts you unexpectedly asking to be sent gift cards (even if –especially if—you think it is a family member, as it may not be). Independently verify!

IF SOMEONE TELLS YOU TO PAY WITH GIFT CARDS:

STOP — do not buy or load a card. You should decline the offer of anyone who insists you pay with gift cards.
HANG UP / walk away. Do not scratch off or share codes/PINs.
