Use of the gift card is governed by the General Terms and Conditions of Hotelgiftcard.com. These explain how the card works, its validity, and your rights as a user.

We provide the platform and the gift card product, but we are not a party to the final contract between you and the accommodation provider.
Hotelgiftcard.com (HGC) acts solely as an intermediary and does not issue invoices for accommodation bookings.

4.1 Purchase:
Gift Cards can only be purchased through HGC or its authorised Resellers.
4.2 Responsibility:
The User is responsible for the secure handling and storage of the Gift Card and any associated codes.
4.3 Use of balance:
The Gift Card may only be used to book accommodation through the HGC website.
4.4 Finality of payments:
All payments using the Gift Card are final once confirmed on HGC’s website.
4.5 Validity and expiry of balance:
This Hotelgiftcard can only be redeemed for booking accommodations on hotelgiftcard.com. No refunds or replacements can be issued in the case of loss, damage, or expiry. No change, vouchers or refunds will be given on the remaining balance. The balance on this gift card can be used until its expiry. This gift card is valid for five years from activation (activation occurs automatically after purchase). The balance, expiry date, and terms and conditions of this gift card can be checked at any time on hotelgiftcard.com.
4.6 Transferability:
The Gift Card may only be transferred free of charge (without payment). The original User remains responsible for secure use.
4.7 Service fees:
HGC charges a transparent booking service fee for reservations made via the Expedia Partner Network. This is clearly displayed during checkout.
5.1 Loss or theft:
HGC is not responsible for lost or stolen Gift Cards. Users must report such issues immediately.
5.2 Misuse or fraud:
HGC reserves the right to block the Gift Card and pursue legal action in cases of suspected misuse or fraud.
5.3 Damage:
If a Gift Card is damaged, the remaining balance may be transferred to a new card, subject to an administrative fee.
6.1 HGC is solely an intermediary for bookings made via the Expedia Partner Network. The contract for accommodation is between the User and the Partner Property.
6.2 Except where liability cannot be excluded under Irish law, HGC shall not be liable for any loss or damage arising from use of the Gift Card or the accommodation contract. Liability is limited to the value of the affected booking, unless caused by gross negligence or fraud.
6.3 Force majeure:
HGC is not liable for delay or failure caused by events outside its reasonable control, such as network outages, government orders, or strikes. HGC will take reasonable steps to minimise disruption.
6.4 Service unavailability:
Temporary inaccessibility of the website or booking functionality is considered force majeure and does not entitle the User to refunds or compensation.
7.1 Physical Gift Cards:
Can be cancelled within 14 days of receipt, provided the balance has not been used.

7.2 Digital Gift Cards:
Are excluded from the right of cancellation once activated or used.
7.3 Business Orders:
Business-to-business purchases are non-refundable.
8.1 Personal data is processed when you use the Gift Card or make bookings through our website. The processing is subject to our Privacy Policy, available at privacy policy, and in compliance with the Data Protection Act 2018 (Ireland) and EU GDPR.
9.1 All intellectual property rights to the name, logo, website, and underlying systems belong to HGC or its licensors. Unauthorised use is prohibited.
10.1 Applicable law:
These Terms are governed by the laws of Ireland.
10.2 Exclusion of CISG:
The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
10.3 Disputes:
Any disputes arising under these Terms shall be brought before the Irish courts, unless mandatory consumer law states otherwise.
10.4 Corporate users:
In cases involving legal entities, both parties must first attempt a negotiated resolution or mediation before legal proceedings may be initiated.
10.5 Severability:
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10.6 Language:
In case of conflict between translated versions of these Terms, the original Dutch version shall prevail.
